Dear Board Secretary,

With regard to the objection by Enbridge to pay our claim, please note that EnviroCentre was awarded and paid costs by the Board for the initial consultation as we followed the rules provided at that time and there were no objections to our contributions, status, or internal working arrangements. The Board subsequently invited all intervenors - including EnviroCentre - to provide comments on the LEAP report and exempted those that had already been awarded costs from re-qualifying.

On that basis, EnviroCentre acted in good faith and provided the Board with well-researched, substantive comments that elicited praise from at least one independent observer. Many months after submitting the modest claim now being opposed, EnviroCentre was informed by the Board that the rules prohibited payments to organizations whose staff represented their employer at Board hearings. EnviroCentre noted that the claim in question was for comments, not representations. It was then explained that the rule is designed to avoid double-dipping by employees of organizations awarded costs. Please note that as an incorporated non-profit organization, any costs awarded to EnviroCentre have been - and would be - paid to EnviroCentre, not any individual, thus avoiding the kind of double dipping that unregulated organizations have apparently engaged in. That being the case, EnviroCentre requests that the Board dismiss the objection in question.

As EnviroCentre has been awarded costs for the current HONI rate hearing application (EB-2009-0096), and as HONI has not opposed costs awarded to EnviroCentre for the low-income hearing, does this mean that EnviroCentre will be paid for its work on HONI's Green Energy Plan regardless of who does it or will a decision on that matter also be subject to opposition after the work has been done?
