We have reviewed the attached letter from THESL. In the interests of speed and efficiency of response, we are replying by email.
SECs interrogatories were presented in the format we have used for dozens of proceedings, perhaps even a hundred or more, over the last few years, and each interrogatory (with the exception of a few standard general ones at the beginning) has a specific reference to the evidence presented by the Applicant. In every other proceeding, this direct reference to the evidence has been accepted as necessarily relating the questions to the issues, since the Applicants evidence is already specifically tied to the issues. To the best of our knowledge, there are no interrogatories that are not squarely within the Board-approved Issues List, and there would appear to us to be no possibility for confusion. Therefore, for THESL now to ask that we identify one or more specific issues for each interrogatory does not appear to serve any useful purpose.
We seek the Boards guidance on this. If the Board wishes that we change our standard interrogatory format, we will of course do so forthwith. However, in our submission, as no other utility has ever had any problem with the format we use, making a change at this stage in this proceeding seems to us to be unnecessary.
