APPrO is concerned about the proposal referenced in the attached proceeding notice to introduce new fees and rates on generator customers of Hydro One. The notice says that costs may be awarded but it makes no mention of cost eligibility being determined in advance of the proceeding. However, it is impractical for organizations such as ours to engage consultants without prior assurance of eligibility.



Could you tell us please if there is any means to determine at the outset if we would be eligible for cost awards? This question would apply as well to the subsequent proceeding EB-2010-0229.



Please be aware that we received notice of this proceeding by courier yesterday, despite a date on the notice of July 22.



Of course, we would be happy if you could refer us to the appropriate member of OEB staff with whom we could discuss such questions.
