Delay in publication of the Notice of Proceeding on Recovery of Costs and Damages for Late Payment Penalty Class Action
Board File Number EB-2010-0295
The Ontario Energy Boards October 29, 2010 Letter of Direction for this proceeding requires that all affected electricity distributors publish, within ten days, the Boards Notice and Application and hearing (the Notice) in one issue of the highest paid circulation newspaper in the distributors service area. Further, the letter directs distributors to inform the Board immediately if this schedule cannot be met. Wellington North Power Inc. hereby informs the Board that it is one of the affected distributors, and the company is unable to comply with the Notice publication schedule.
The newspaper having the highest paid circulation in the Wellington North Power Inc. service area is published weekly and therefore it is beyond the companys ability to publish before Wednesday, November 13th, 2010.
The original letter will be forward to the Board Secretary by courier today, November 4th, 2010.
