Re: EB-2007-0606/EB-2007-0615

I am writing on behalf of the London Property Management Association (LPMA),
the Wholesale Gas Service Purchasers Group (WGSPG) and the Building Owners
and Managers Association of the Greater Toronto Area (BOMA).

I am in receipt of a letter dated January 4, 2008 from Mr. Penny enclosing
new written evidence to be filed on behalf of Union Gas. I have also
received letters dated January 7, 2008 from Mr. Shephard on behalf of SEC,
Mr. Buonaguro on behalf of VECC and Mr. DeRose on behalf of IGUA all
responding to the new evidence.

I support the comments of Mr. DeRose with respect to the need for Union Gas
to file a motion to obtain leave of the Board to file late evidence. Union
should address the procedures that are necessary to ensure that other
parties have the opportunity to adequately review this new evidence, if
allowed, and to respond to if it necessary.

We agree with Mr. DeRose that the appropriate procedures include an
opportunity to consult with other experts, the inclusion of an interrogatory
process and/or technical conference and the opportunity to file additional
evidence.
