As a follow-up to the email below, EnWin has established that the number of USL Connections as of December 31, 2009 to be 784.

EnWin has re-reviewed the RRR filing requirements and it appears that EnWin was justified in originally using the number of USL Customers for the 2009 RRR 2.1.5. However, in order to be in compliance with the Board Order in EB-2010-0295, it appears that EnWin ought to amend its 2009 RRR 2.1.5 filing. EnWin notes that this would appear to be an industry-wide issue, not an EnWin-specific issue.

Given that the Order in EB-2010-0295 requires EnWin to make its IRM filing in respect of the proposed USL rate rider no later than March 1, 2011, be advised that EnWin intends on using the USL Connections number "784" instead of the USL Customer number "29" as part of that calculation and filing that calculation no later than March 1, 2011. In the event that the Board does not confirm/permit an amendment to the 2009 RRR 2.1.5 prior to March 1, 2011, EnWin will note the variance between its March 1, 2011 IRM filing and the 2009 RRR 2.1.5 filing of record and use the correct value (784) to calculate the proposed USL rate rider.

In preparing EnWin's filing in respect of the LPP proceeding (EB-2010-0295), an issue was discovered in respect of EnWin's 2009 RRR 2.1.5.

Specifically, a field requested the number of Scattered Unmetered Loads (USL). Other fields on the same table that requested such things as the number of Residential Customers and the number of Streetlight Connections. EnWin understood "Loads" to be a reference to the number of Customers rather than the number of Connections.

However, in light of the direction in proceeding EB-2010-0295, it is clear that the number entered should have been the number of USL Connections. EnWin's rate riders for the USL class are all on a "per connection" basis.

As an illustration of the significance of the difference, in the RRR filing, the number of USL Customers was 29. In EnWin's 2009 Cost of Service rate application, the number of USL Connections was approximately 890. The resulting rate rider under each scenario would be considerably different.

EnWin is currently working through its archives to determine the number of USL Connections for the 2009 RRR 2.1.5. EnWin's expectation is to have that number sometime on February 25, 2011.

Please advise us on the next steps required to amend the RRR Filing.
