Ms. Walli,



I am concerned that this application was filed and notice was not sent directly to this office. We were notified of the withdrawal of the previous application before the Board for this project and were under the assumption that we would be circulated in any future application for this project before the board.



The County had been in significant negotiations with Tribute/Bayfield Pipeline with regards to an agreement for installation of a pipeline in a suitable location within the right of way of County Road 17 (Nairn Road). Without any agreement in place to allow for construction within Middlesex County right-of-ways we feel that it is premature to allow for construction along this route.



I am unsure of what status this may have on this project but I feel it is appropriate to notify the Board that no agreement is currently in place and that the current proposed routing cannot be approved without an executed agreement. Our last communication with Tribute/Bayfield was back in February of 2010 and the County has not received any correspondence for this project from any source until the notice of the withdrawal of the application on March 18, 2011.



The County would be interested in some status at any proposed hearing, whether as an observer or an intervenor. I understand that the deadline has passed but I have only become aware of the hearing today after returning from vacation. While not in opposition to the project, I cannot approve the use of Middlesex County right-of-way for any proposed pipeline without an executed agreement, and there remain several issues to be resolved before an agreement may be reached.



This may or may not have a significant impact on the BoardÂ’s decision for this project, and I await direction from your office on how you would like the County to participate.
