Subject: re. EB-2011-0394 -- Deadline for filing interrogatories

Dear Ms. Walli:

MCSEA wishes to bring to the Board's attention a number of concerns
with respect to the deadline for filing interrogatories.

There appears to be an error in the corrected version of Procedural
Order #1 dated January 27, wherein the deadline for intervenor
interrogatories is indicated on page 6 to be "Friday, February 15,
2012". There is an apparent error here as the date for Friday is the
17th.

Another concern that relates to the deadline for filing of
interrogatories is that there is one confidentiality matter still
outstanding, that relates to disclosure by McLean's Mountain Wind Farm
of the lands it claims are required for its proposed transmission
facilities. This is a key concern for MCSEA and allied intervenors.
Resolution of this disclosure matter will assist us in scoping our
intervention and information requests.

Another concern of particular importance to rural citizens attempting
to participating in a regulatory proceeding that so directly affects
our interests is access to information on what is proposed. Unlike
many applicants appearing before the Board, McLean's Mountain Wind
Farm has not made its application available to the public through its
web site. Documents are available at the offices of McLean's Mountain
Wind Farm, but that office is not easily accessible for all of the
intervenors, particularly during harsh winter weather in Northern
Ontario.

In light of the unresolved confidentiality matter and the late
interventions from CP and Manitoulin Nature Club, MCSEA suggests that
the dates set out in Mr. Sidlofsky's letter of February 9 with respect
to interrogatories from CP to McLean's Mountain Wind Farm be applied
to all parties. That date is March 2.

Sincerely,
Raymond Beaudry
MCSEA
