Hello Edik,

As per our discussion this morning. We are writing to confirm that Board
counsel will not be able to assist MCSEA interveners in this proceeding.

MCSEA is disappointed with the position of Board Staff on this issue.

MCSEA is a first time intervener not presently represented by counsel.
Our members are located a long distance from the Ontario Energy Board
offices. It is our understanding that historically, Board counsel
assisted interveners in various ways, such as by asking questions in oral
proceedings on behalf of interveners unable to attend. We urge Board
Staff to reconsider its position on this matter.

MCSEA continues to believe that the appropriate course of action for a
proper review of this application is for the Board to convene an oral
hearing.

As discussed, upon receipt of the interrogatory responses, the Board will
be issuing a response.

MCSEA will be reviewing them also to determine our future evidentiary
requirements and will also be considering whether we need to make further
submissions on the benefits of an oral hearing.

We look forward to information on the composition of the Board Panel as
soon as this information is available to any other party to the
proceeding.
