As the November 22, 2012 hearing date for EGDI’s 2011 ESM proceeding is approaching, we write to seek information from parties about their intentions for the hearing.Â

Â

EGDI will be presenting two panels to provide evidence and answer questions in relation to the two outstanding issues in the 2011 ESM proceeding.

Â

Panel 1                Jody Sarnovsky and Don Small will be the Company’s witnesses in relation to the outstanding aspect of the 2011 Transactional Services Deferral Account (Issue 1R). As you will recall, the Settlement Agreement indicates that the “unsettled issue” with respect to the 2011 TSDA is “Has Enbridge treated the upstream transportation revenues appropriately in 2011 in the context of Enbridge’s existing IRM Agreement?”

Panel 2                Kevin Culbert, Arvind Dhoot (a CV for Ms Dhoot will be provided shortly), Steve McGill and Barry Yuzwa will be the Company’s witnesses in relation to the outstanding aspect of the 2011 Earnings Sharing Mechanism Deferral Account (Issue 1L). As you will  recall, the Settlement Agreement indicates that the “unsettled issue” relates to ”the amount of the provision for uncollectible for the purposes of the 2011 earnings sharing calculation.”Â

As a result of the Board’s Approval of the Settlement Agreement in EGDI’s 2013 Test Year proceeding EB-2011-0354 at Issue B-6, the other unsettled issue from the 2011 ESM proceeding (relating to the allocation of costs between regulated and unregulated gas storage activities) is now resolved.

In order that we may plan for the hearing (including whether the hearing can be completed in one day), please provide me with an indication of your intent to cross examine either panel, along with a time estimate for your cross examination(s). We would appreciate your response by the end of the day on Friday November 16th.
