Subject: EB-2016-0004 - Northwest Witness Availability

Further to the Board's email dated April 26, 2016, Northeast does not wish to cross examine any of the evidence presented in the matter of EB-2016-0004.

In relation to the availability of Northeast’s expert, Mr. Gulick lives and works in California, and a number of the dates conflict with other commitments related to his practice.

As a result, Northeast respectfully requests the Board’s indulgence that Mr. Gulick appear via teleconference or video conference. He will do his upmost to adjust his agenda to accommodate the Board’s schedule.

If it is deemed essential that Mr. Gulick be present in person for oral cross-examination, Mr. Gulick would be available to appear on one day only, May 11, 2016, and Northeast asks that he be called during the morning session in order to make a return flight later that day.
