I understand that you are in a meeting today re SME Working Group. The agenda was provided to me from one of the attendees, and is attached for the benefit of those copied on this email.

You may hear today that certain LDCs, particularly the members of the CLD, are very concerned about the privacy violation implications in the proposed requirement to provide the complete 6 digit postal code. There are customers who would become identifiable with the provision of that information, due to the fact that there are postal codes affiliated with only one customer. We are also very concerned about the provision by the SME/IESO of this data to third parties. Â

The electricity distributors in this province are vulnerable to lawsuits by customers who may accuse us of breaching privacy laws, if this proposal is approved as is, without any legislation, regulation or Board order requiring us to provide this data to the SME.

For that reason, I am asking the OEB via this outreach to you, to please require the LDCs to provide this information to the SME. This can be achieved via an order from the Board or via a generic, wholesale amendment to all electricity distributor licences.

Please let me know how we can move this issue up the necessary channels at the OEB.

You will see that in addition to members of the CLD, I have also copied Paige Backman of Aird&Berlis, who is acting on the CLD’s behalf on this issue, and in discussions with the SME/IESO and the Information and Privacy Commissioner’s office.
