As you know, we are counsel to Horizon Utilities in this matter. We are
working with our client to prepare Horizon Utilities' submission in
reply to the five submissions delivered by e-mail last week (Board Staff
June 30th; intervenors mid-afternoon July 2nd [CCC/VECC], 11:59 pm July
2nd [SEC] and 2:15 am July 3rd [EP]), but we must advise that Horizon
Utilities will require a brief period of additional time to finalize its
reply. We do not believe that the intervenors will object to this - you
will recall that Mr. Warren, counsel for CCC, had provided his consent
to an extension of the deadline for reply when he requested that the
deadline for staff/intervenor submissions be shifted to Wednesday, July
2nd in light of Canada Day-related office closures on June 30th and the
Canada Day holiday on Tuesday, July 1st (see below), and we thank Mr.
Warren for that.

At this time, we anticipate that the reply submission will be delivered
at the end of the day on Monday, July 14, 2008. We will advise the
parties if that timing estimate changes. We thank the Board in advance
for its consideration in this regard.

As is the case with many businesses, our firm will be taking the
July 1 holiday on Monday, June 30, 2008, rather than on Tuesday, July 1,
2008. In addition, many of our staff will be taking Tuesday off, as
well.

As a result, it will almost certainly be impossible for us to
file our client's argument in this matter until July 2, 2008. Given the
several delays in this matter, we assume that Horizon and its counsel
will have no objection to this. Should Horizon need additional time for
a response, we would understand, and have no objection.
